Terms of Service

1. Agreement

These Terms of Service ("Terms") are an agreement between Baiam ("Baiam", "we", "our", or "us") and the merchant, business, or user accessing Baiam ("you"). By using Baiam, you agree to these Terms.

2. Baiam Services

Baiam provides AI-powered commerce operations software that helps Shopify merchants monitor store activity, understand operational priorities, and review suggested actions. Baiam is designed to support merchant decision-making and does not replace your judgment or responsibility for store operations.

3. Shopify Account and Permissions

To use Baiam with a Shopify store, you must have authority to install and authorize apps for that store. Baiam may access Shopify data only through permissions authorized during installation or later approval. You are responsible for maintaining access to your Shopify account and complying with Shopify policies.

4. Subscriptions and Billing

Paid subscriptions and charges are managed through Shopify billing unless otherwise stated. Prices, trial periods, renewals, cancellations, and taxes are presented through Shopify or Baiam purchase flows. You are responsible for charges approved by your account.

5. Acceptable Use

You may not misuse Baiam, attempt to disrupt or reverse engineer the service, violate laws or third-party rights, submit harmful code or content, bypass usage limits, or use Baiam to make unlawful, deceptive, or harmful business decisions.

6. AI Outputs

Baiam may generate forecasts, summaries, recommendations, and other AI-assisted outputs. AI outputs may be incomplete or inaccurate. You are responsible for reviewing outputs before relying on them or taking action in your business.

7. Data and Privacy

Our handling of personal information and merchant data is described in the Privacy Policy. By using Baiam, you authorize us to process data as needed to provide the service.

8. Third-Party Services

Baiam depends on third-party platforms and service providers, including Shopify. We are not responsible for third-party services, policies, outages, changes, or actions outside our control.

9. Intellectual Property

Baiam and its website, software, branding, designs, and content are owned by Baiam or its licensors. These Terms do not transfer ownership rights. You retain ownership of your store data and content.

10. Service Availability

We work to keep Baiam reliable, but the service may be unavailable due to maintenance, updates, network issues, third-party outages, or events outside our control. We may change, suspend, or discontinue parts of the service as needed.

11. Limitation of Liability

To the fullest extent permitted by law, Baiam will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities.

12. Termination

You may stop using Baiam or uninstall the app at any time. We may suspend or terminate access if you violate these Terms, create security or legal risk, or use the service in a harmful way.
